Smith Debnam’s Community and Homeowner Associations practice group specializes in the representation of community associations, homeowner associations, property management organizations and real estate developers in a wide array of matters in both North Carolina and South Carolina. We assist in the formation of planned communities by:

    
· Providing counsel to developers
    
· Drafting restrictive covenants
    
· Forming associations, including the drafting of
       governing declarations, association bylaws and
       other pertinent operational documents

Our team is equally adept at representing existing associations directly or through property management companies. We regularly:

    
· Analyze and interpret bylaws and restrictive
       covenants 
    
· Collect assessments
    
· Enforce restrictive covenants 
    
· File and foreclose liens for past-due
       assessments, fines, late fees and/or related
       charges. 

In addition, we keep our association and property management clients up-to-date regarding changes in the law through ongoing contact and regularly scheduled seminars addressing important topics in this growing field of practice.
