Chad A. Sharkey primarily concentrates his practice in commercial litigation with an emphasis on creditor’s rights. His practice includes creditor representation in commercial bankruptcy cases and the defense of preference actions, representation of equipment lessors, construction litigation, lender liability litigation, and general business litigation. Mr. Sharkey also is experienced in handling a variety of legal matters for small and large business clients, including drafting contracts and leases and structuring secured transactions. 

Mr. Sharkey regularly represents equipment lessors and other creditors in various commercial collection proceedings including state and federal court litigation, claim and delivery hearings, arbitrations, and mediations.

With respect to his bankruptcy practice, Mr. Sharkey represents secured, unsecured, and lease creditors protecting their rights and interests in cases and adversary proceedings under Chapters 7, 11, and 13 of the Bankruptcy Code. He also represents creditors in defending against preference claims brought by debtors and trustees.

In his construction practice, Mr. Sharkey has represented materialmen, owners, general contractors, and subcontractors in matters involving materialman’s liens, breaches of contract, and construction defects in state and federal courts. 

Mr. Sharkey has been practicing since 2000. He is experienced in representing clients before the North Carolina trial courts and Court of Appeals, as well as before the United States District and Bankruptcy Courts in North Carolina. Mr. Sharkey has also represented his clients’ interests in bankruptcy cases in Virginia, Delaware, Kentucky, Texas, West Virginia, Georgia, and before the United States Court of Appeals for the Fourth Circuit.
